Jackson Walker L.L.P. successfully guided its client, Dr. Robert Dull, an Austin investor with several significant real estate holdings in Nicaragua, through a real estate transaction that had turned sour.

The Spanish-language transaction involved a promesa de venta on a hotel property – which under Nicaraguan law bound both parties to purchase and sell the property without variation of its terms, despite the fact that the document did not accurately reflect the agreement of the parties.

Dr. Dull was represented by Jackson Walker partner Arcie Jordan. Ms. Jordan became involved after communications between the parties had broken down. In representing her client, Ms. Jordan identified available options, designed alternative strategies, and re-established communications with the buyer and her various U.S. and Nicaraguan representatives. Working within a tight timetable, Ms. Jordan conducted negotiations with the U.S. counterparty to reach a satisfactory resolution and worked with local counsel to implement the same. The end result preserved the client’s interest in the hotel property, protected the client from a cumulative loss of over $550,000 USD, and netted an alternative sale on mutually satisfactory terms.
