Jackson Walker L.L.P. successfully defended its client Standard Renewable Energy, LP (SRE) in a three-day jury trial involving claims brought against the Dallas-based green energy company by a consumer over a geothermal HVAC and solar panel installation.

After SRE was unable to complete the installation of the geothermal system due to circumstances outside of its control, two former customers sued SRE under theories of fraud, negligent misrepresentation, breach of contract, and violations of the Texas Deceptive Trade Practices Act. After Jackson Walker attorneys Chris Mugica and Kimberly Gdula successfully argued for the dismissal of several of the warranty, DTPA, and fraud claims by summary judgment, the remaining claims for breach of contract and fraud were tried before a jury in the 393rd Judicial District Court in Denton, Texas.

After less than 50 minutes of deliberation, the jury returned a take-nothing verdict in favor of Jackson Walker’s client SRE and awarded costs against the plaintiffs.
